NSW Common Questions about Skilled Visas Updated as follows  

 

Can my ROI be prioritised? 

No. We cannot prioritise ROIs for any reason.  

All ROIs validly submitted during a submission window will be considered.  

 

I didn't use my invitation from last round, can I submit a new ROI this submission window? 

No. If you do not apply to your preferred region before your invitation expires, or your application has been declined, you must wait a period of 12 months before submitting a new ROI. This includes for a different occupation or nomination stream.  

 

Am I eligible for NSW nomination if I am currently residing offshore? 

No. You must be currently residing in an Australian state or territory to be eligible for NSW nomination.  

We cannot provide a timeframe when this requirement will change.  

 

Where can I live and work in NSW if I hold a Skilled Work Regional visa (subclass 491)? 

Home Affairs determines which regions of Australia are eligible for the Skilled Work Regional visa (subclass 491). Eligible regions are published on the Home Affairs designated regional area postcodes website. 

 

I am subject to a section 48 bar, will NSW renominate me if I'm unable to apply to Home Affairs? 

The section 48 bar applies to applicants who have had a visa refused or cancelled since their last entry into Australia. If you are subject to a section 48 bar you need to leave Australia before you can reapply for a visa. 

NSW will not renominate applicants who are subject to a section 48 bar where their nomination has expired and they are unable to leave Australia. 

 

Can I submit more than one ROI during a submission window? 

No. You can only register your interest once during a submission window.  

Submitting more than one ROI during a submission window will result in your removal from consideration  this includes where you are skilled in more than one occupation.  

If you are skilled in more than one occupation, you must submit your ROI for one occupation only.  

 

Can I amend or withdraw my ROI? 

No. ROIs cannot be amended or withdrawn after they are submitted.  

When you submit your ROI during the submission window does not affect your likelihood of being invited to apply for nomination. 

As such, do not submit an ROI early in the submission window if your circumstances are likely to change.  

 

I cannot provide evidence for all the claims in my ROI and/or SkillSelect EOI, can I still accept my invitation? 

No. If you cannot provide evidence for all the claims in both your ROI and SkillSelect EOI, you cannot accept your invitation to apply for nomination.  

Your application will be declined if you cannot provide evidence for all claims in your ROI and SkillSelect EOI.  

If your application is declined you must wait a period of 12 months before submitting a new ROI. This includes for a different occupation or nomination stream.  

 

How long is an invitation valid for? 

If you are invited by NSW, you have 14 days to apply to a NSW region where your skills are required  you can only apply to one region. 

Invitations will not be reissued if they expire.

Which regions can I apply to if I am invited by NSW? 

A list of participating regions is available on our Skilled Work Regional visa (subclass 491) page.  

If you have been invited to apply for NSW nomination, you can apply to any region where your skills are required  i.e. your nominated occupation appears on the region's occupation list. 

Candidates invited to apply under Stream 1 have access to a combined occupation list to ensure they can apply to the region where they currently live and work. 

Stream 1 candidates are strongly encouraged to apply to the region where they currently live and work.
